STUDENT WAIVER OF LIABILITY ASSUMPTION POLICY
All Georgia College students engaged in any and all voluntary activities sponsored by the college must sign the appropriate Assumption of Risk and Waiver of Liability forms contained in this policy. The policy and forms specifically include intramural activities and all non-credit activities involving students on a voluntary basis. For example, a debate trip requires the use of the forms because being a member of the debate team is voluntary. Intramural athletic participation does also. (Intercollegiate athletics has a form and procedures designed for their use.) Participants in Continuing Education activities should sign the Waiver of Liability and Assumption of Risk form.
Students enrolled in academic courses required by Georgia College for a degree or major cannot be required to sign the Waiver of Liability or the Assumption of Risk forms due to the fact that the student is being required by the college to take the course. If the activity is required as a part of a required course or connected with a degree requirement, the forms do not apply, since a student cannot waive liability or assume risk if the college is requiring him/her to participate in order to obtain a degree. If the activity is voluntary, the forms must be signed. The key is "voluntary." Therefore, all courses being offered for academic credit which students are required to complete for degree purposes are not involved in the use of the Waiver of Liability and Assumption of Risk forms. For example, Wellness courses are required by the college for all Bachelor degrees. However, the student has a choice of those courses to take. As a result of this choice, the student must sign the Waiver of Liability and Assumption of Risk forms. Also, students who participate in Field Trips associated with any course must sign the Field Trip Release form. Students enrolled in ROTC/Military Science courses will sign the Waiver of Liability and Assumption of Risk forms. Students enrolled in Internships and Co-operative Education assignments are required to complete the Waiver of Liability or Assumption of Risk form provided by that office.
The Waiver of Liability and Assumption of Risk forms must be signed by the students or participants prior to the initiation of the activity involved. All forms should be filed in the office initiating the voluntary activity.
It is the policy of Georgia College that all students should have HEALTH INSURANCE. All participants in Continuing Education activities should be informed that they should have insurance coverage. All faculty and staff should not assume any risk in the absence of being covered by their own personal insurance policies.
Please be advised that college personnel (faculty and staff) are not insured against NEGLIGENCE. All college personnel are individually liable if personal negligence can be shown.
The Student Affairs Division and Continuing Education Office have copies of Release and Waiver of Liability forms.
