CONSULTING NOT COVERED BY PROFESSIONAL LIABILITY INSURANCE

The Board of Regents, at its January 14, 1987 meeting, approved Amendatory Endorsement #6. The effect of the amendment is to exclude coverage for "participation in consultation practice (prestigious consulting) in the employee's discipline or related subject areas when such consultation is for the employee's personal gain and where the contract for the service is between the employee and the third party benefiting from the consultation."  The effective date of the endorsement is July 1, 1987.

As a result of Amendatory Endorsement #6, faculty members and others engaged in consulting activities are no longer covered by the Board of Regents Professional Liability Insurance Plan for their consulting activities.

A secondary effect of the amendment is to absolutely exclude certain activities, including consulting activities, from coverage. Until the amendment, institutional authorities could extend coverage in certain cases with written authorization. This is no longer true.
